In the present study, place and importance of `Sunnah` tried to be put forward in Islamic religion based on Hanefian sect in a systematical way by considering enactment of law duty, which is among the main functions of Sunnah in terms of manner and the example of Islamic law.In the research main subject were evaluated in relation directly with legislation authority of Sunnah in understanding and applications of religion. In this context, it was mentioned in the fırst part that the subject is related directly to manner and the feature of being source and relationship between `Sunnah and Qur'an, classification of Sunnah` for obligation and the reforms of the Prophet Muhammed were evaluated. Primarily the views of Hanefian scholars were evaluated in terms of the mentioned subjects as well as those of ehl-i sunnah researchers. After the views adopting and nota adopting that Sunnah is a sole enactment of law source were studied together with their evidence. In the last part, the examples related especially to decisions about the functional Islamic law valid in practical daily life were evaluated and the enactment of law value of Sunnah was determined by considering the mentioned examples. When studying the examples, words of the Prophet on especially the Islamic law decisions were taken into consideration. Such types of hadises were also evaluated for the view whether new decisions can be built on them healthly. Evidence from basic Islamic laws sources were taken to determine whether the decision is fixed and the meaning of Sunnah related to the subject of the decision. In Islamic history, ehl-i sunnah sects have been given different names based on the dynamisim and identities existing in the essences of inferrence in Islamic law. In this frame, Hanefi sect is named to be ehl-i rey while other ehl-i sunnah sects to be ehl-i hadis. By considering the entire decisions in laws and their basis and evidence, the name given to Hanefi sect as if it is opponent to Sunnah is thought to be not suitable and mismatched. As can be seen in the examples of İslamic law, Hanefian scholars adopted the hadises related to a subject to be a base directly for the mentioned subject, considered them to be şer'i source and they accepted the new situation to be determined without needing any supports from Qur'an and icma (inferrence). Keywords: Sunnah, Hanefian, legislative, religious decisions, independent.

Bu çalışmada Sünnet'in İslam Dinindeki yeri ve önemi, Sünnet'in temel fonksiyonlarından olan teşri' görevi esas alınarak hem usul yönüyle, hem de füru' fıkha dair örnekleriyle sistematik bir şekilde temelde Hanefi mezhebi esas alınmak suretiyle ortaya konmaya çalışılmıştır.Araştırmada İslam Dininin anlaşılması ve yaşanmasında Kur'an'dan sonra ikinci kaynak olan Sünnet'in yasama yetkisiyle doğrudan ilintili olan temel konular incelenmiştir. Bu çerçevede birinci bölümde konunun usul yönüyle doğrudan ilişkili olduğu; `Sünnet'le Kur'an arasındaki kaynaklık vasfı ve ilişkisi`, `Sünnet'in kaynağı`, `Sünnet'in bağlayıcılık açısından tasnifi` ve `Hz. Peygamber (sav)'in ictihadı` konuları işlenmiştir. Söz konusu hususlarla ilgili Hanefi mezhebi uleması başta olmak üzere ehl-i sünnet bilginlerinin görüşleri değerlendirilmiştir. İkinci bölümde, Sünnet'in müstakil teşri' kaynağı olduğunu kabul eden ve etmeyen görüşler delilleriyle birlikte ele alınmıştır. Bu çerçevede Hanefi mezhebinin ehl-i rey, diğer ehl-i sünnet mezheplerin ise ehl-i hadis olarak isimlendirildiği bilinmektedir.
