The crime of conspiracy, that is, in definition, no less than three or more persons establish an organized structure for an unspecified time to commit unspecified number of offences, is of a preparatory nature, and is defined as a constant crime. At the same time, criminal conspiracy is a danger-based crime besides its optional act-crime and multi-actor-crime.In Turkish Criminal Code, the elements of criminal conspiracy are counted following as: an organized structure, continuation, three or more conspirators (persons), and the mens rea (criminal intent). A combination of three or more persons is required to establish a conspiracy. Despite the Criminal Code defines the three persons as the members of the conspiracy, this is not a right characterization. These three should be punished as founders of the conspiracy in accordance with the law. If a criminal conspiracy, though established by three persons to commit offences, had not the physical capacity to commit the designated offences, it should not be punished, since the capacity to commit the offence is not the founding element of the crime of conspiracy but a condition for the implementation of the punishment.Criminal conspiracy exists only in the context of committing crimes and not of committing misdemeanors. The crime of leading a conspiracy requires the actual leadership of conspiracy, and thus the mere assignment to be leader of a conspiracy is not enough to characterize such crime. Those who are willfully participated in an already set up-criminal organization are characterized as the members of conspiracy. In another word, to establish the membership, it is not required to take the consent of leaders. In order to characterize an offence as a crime committed within the conspiratorial agreement, it is necessary for the offence to be carried out in accordance with the object of the conspiracy. Those who have committed the said offence should also be authorized by the leaders of the conspiracy.Crime of aiding a conspiracy is established when a person who is not situated within the hierarchy of the conspiracy structure (those who are not for example founders, leaders or members of conspiracy) aid, assist, or give support to the conspiracy. There should also exist a criminal conspiracy within the meaning of Turkish Criminal Code at the time of aiding, assisting or giving support to.
