Özet

ABSTRACT Crimes committed by terrorist organisations were considered first under the Turkish Penal/Criminal Code (TCK-Law No: 765). The investigated subject, 'offences committed by terrorist organisations', was dealt within `armed organisations or gangs` in the Turkish Penal Code (TCK-Law No: 765) article 168 and in which activities defined as offences by terrorist organisations are subject to certain penalties. The first anti-terror law 'Anti-Terror Law' which brought some historical changes into the Turkish Penal Code and put forward some rules in terms of juridical procedures was accepted in 1991. With Anti-Terror Law there have been developments in terms of regulations. Article 7 of 'Anti-Terror Law' has brought regulations to offences committed by 'terrorist organisations'. There has been rearrangements to the offences committed by 'armed organisations' in the article 314 in the Turkish Penal Code (TCK-Law No: 5237) published on the 12th of October 2004 in the Official Gazette (Resmi Gazete Issue No: 25611) which became in accordance with the Turkish Penal Code (TCK-Law No: 765) article 168. This study analyses article 168 in the Turkish Penal Code (TCK-Law No: 765), article 314 in the Turkish Penal Code (TCK-Law No: 5237) and article 7 of the 'Anti-Terror Law'.
