The concept of republic is a subject of different characterization and explanation attempts in the fields of philosophy, politics, and constitutional theory. These different characterizations and explanations are derived from the concept's historical evolution. From the ancient to modern ages the concept of republic has been used for denominating different political unities. On the one hand the works on the concept of republic from particular disciplines create a rich literature; on the other hand they make the concept indistinct. Therefore it is vital to think the concept in the intersection set of separate disciplines. In this thesis, the concept of republic is analyzed in conjunction with the concepts of constitutive power, popular sovereignty and national sovereignty and in the intersection set of political philosophy and constitutional law. The most simple and popular definition of republic is that it is the political regime which depends on popular sovereignty. Accordingly, every republic either bases on the fiction of popular sovereignty or the fiction of national sovereignty. These two different fictions of sovereignties are the sources of two separate forms of republic. The fiction of popular sovereignty identifies the people as a concrete and partite multitude and the fiction of national sovereignty, conversely, identifies it a transcendental and noncontradictory unity. These two fictions enable us to think two separate republics and the dynamic relation between them.Constitutions of 1921 and 1924 constituted two particular orders in Turkey. While the first of them is based on popular sovereignty, the second is based on national sovereignty. The conflict between these two fictions paves the way for constructing a dynamic concept of republic which will provide us a comprehensive insight through the constitutional order of Turkey. Cumhuriyet kavramı felsefi, siyasal, anayasal ve hatta ideolojik olarak farklı tanımlama ve anlamlandırma girişimlerinin konusu olmuştur. Farklı tanım ve anlamladırmaların nedeni, kavramın antik çağdan bugüne farklı tarihsel momentlerde, siyasal birliğin farklı formlarını adlandırmada kullanılmasıdır. Cumhuriyet kavramı üzerine farklı disiplinlerde geliştirilen eserler, bir yandan zengin bir literatür oluşturmakta, bir yandan da kavramın içeriğini belirsizleştirmektedir. Bunun nedenle, kendi üzerine kapanan bir disiplin içinden değil, disiplinlerin kesişim alanında kavramı incelemek önem taşımaktadır. Bu çalışmada cumhuriyet, anayasa hukuku ile siyaset felsefesinin kesişim alanında bulunan kurucu iktidar, halk egemenliği ve ulus egemenliği kavramları ile birlikte ele alınacaktır. En basit ve bilindik tanımıyla cumhuriyet, egemenliğin kaynağının halkta olduğu bir siyasal düzeni işaret ediyorsa, her cumhuriyet ya halk egemenliğine ya da ulus egemenliğine dayanmaktadır. Bu iki egemenlik kurgusu iki karşıt cumhuriyet biçiminin kaynağını oluşturmaktadır. Halkı somut ve parçalı bir çokluk olarak temeline alan halk egemenliği kurgusu ile soyut ve çelişkisiz bir birlik olarak ulusa dayanan ulus egemenliği kurgusu, iki karşıt cumhuriyeti ve bunların arasındaki dinamik ilişkiyi düşünmeye olanak sağlamaktadır.Türkiye'de 1921 ve 1924 Anayasaları, halk egemenliğine ve ulus egemenliğine dayanan iki karşıt cumhuriyet kurgusuna dayanmaktadır. 1921'de sınıfsal ve etnik olarak parçalı bir halka, yerel özerkliğe ve ilkesel olarak halkın bizzat ve bilfiil yönetimine dayanan Anayasa, 1924'te, ulusal birliğe, merkezi idareye ve saf siyasal temsile dayandırılmıştır.1921 ve 1924 düzenlerinin dayandığı kararlar arasındaki çatışmanın tespiti, Türkiye'nin anayasal düzeninde dinamik bir cumhuriyet kavramının inşasına zemin hazırlayacaktır.Anahtar Kelimeler: Cumhuriyet, Anayasa, 1921 Anayasası, 1924 Anayasası, Ulus egemenliği, Halk egemenliği, Kurucu iktidar.
