Özet

Despite the presence of various institutions in our law regarding the betterment of the financially impaired debtors, they could not have been operated effectively due to various reasons. As being the mostly appealed method for the betterment of the financially impaired capital companies and cooperatives, postponement of bankruptcy has been annulled by virtue of the Law (No.7101) on the Change in the Enforcement and Bankruptcy Law and Some Other Laws. In place of the postponement of bankruptcy institution that has been annulled by virtue of the Law No.7101, provisions on concordatum, that were applicable, but not appealed effectively, have been revived by structural changes. Having been dealt with both legally and financially in this study, the concordatum institution has been compared with similar applications, and the process of the restructuring of the debts of the capital companies and cooperatives by way of non-bankruptcy concordatum has thereupon been assessed comprehensively together with the case of a concordatum project appertaining to a production enterprise.
