Ceza muhakemesinin farklı aşamalarında uygulanan erteleme esasına dayanan hükmün ertelenmesi kurumunun karşılaştırmalı hukuk ve Türk Ceza Adalet Sistemi?ndeki amaçları, yeri, uygulanması ile sonuçlarının araştırılması bu çalışmanın konusunu oluşturmaktadır. 19.

The survey of the goals, position and implementation of deferment of judgement institution, which is implemented at the different stages of the criminal proceeding and which is based on the principal of deferment, within the comparative law and the Turkish Criminal Justice System constitutes the subject of this study. Since the 19th Century, the conception that the imprisonment is the best sanction is abandoned and the thought of ?prevention and the amelioration of the offender? became prevailing in criminal law. Besides the fact that applying imprisonment does not bring success in fighting with criminality, the transformation of the prisons to criminal schools, the cost of the execution of imprisonment and the increase in workload of the courts were effective in the development of this idea. Thus, the thought that applying imprisonment must be the ultimate ratio gained acceptation in the modern criminal law. In this respect, instead of imprisoning especially the individuals who are first time offenders or who can be corrected trying to ameliorate and integrate them to the society by giving them one more chance, that is fighting with criminality by deferment, raised as a humanistic option. Doubtlessly, not immediately marking the offender and executing the sentence but instead calling upon the institutions correction him and integrating him to the society is consistent with the humanist character of the criminal law and the humanity values of our age. The goal of ensuring the offender's not tending to criminality again by keeping the offender under supervision for a while and deferring the criminal proceeding about him constitutes the basis of the ?deferral? thought. The deferral institution which has arisen in a simple manner at the beginning; has expanded with the effect 715 of the Anglo-American system which suggests that the offender must be kept under treatment and/or surveillance for correction and headed towards the system of disincarcerating the offender under survelliance. In this way, the probation institution has gained acceptance in the Continental Europe and the probation institute has been employed at different stages of the criminal proceeding. Especially in deferment of the judgement for the children and the first time offenders, it is tried to prevent the re-involvement in criminality of the first time or incidental offenders by the state's renouncement of its right to penalise the offender in return for his good conduct in a definite period. By this way, it is tried to fulfil the prevention goal of the criminal law in an effective and humanistic manner. Moreover, deferment institution contributes to the implementation of ?restorative justice? concept and therefore to the achievement of social peace by having room for ?compensation of the damnification due to the crime? and by its property of diversion of the suspected out of the system. In this respect, the deferment institution which has different applications has become an indispensable tool of punishment policy of present-day. From the point of view of development of criminal proceeding, it is possible to prevent the offender's re-involvement in a crime by benefiting the judgement as a tool for correction and integration to the society of the offender of the crime by deferring the disclosure and legal consequences of the judgment made or to be made for a while and with definite restrictions. In this respect, the humanistic and emancipatory character of the criminal proceeding law is highlighted with the deferral of the judgement. The deferment institution in our country had been implemented until 2005 being limited merely to deferral of the execution of the penalty. Together with the new Criminal Justice System the implementation scope of the deferment institution has expanded significantly and, although lately, it has taken its place in the legislation with its name being ?adjourment of the disclosure of the judgement?. The institution which could be applied in a limited manner in the beginning, gained a quite wide implementation scope with a regulation done in the year 2008. Since the mentioned institution is recently adopted in our legal system, although its development in the world goes back to very old times, the scrutinization and discussion of it with all its facets will be beneficial for fighting with criminality. Moreover, the importance carried by the court decisions and especially the Court Of Cassation jurisprudence and the academic studies for sufficiently benefiting the deferral of the judgement institution, which is a candidate for taking over important functions within the present-day criminal law, is indisputable. In this respect, for the implementation and effective application of the institution, the belief of the law practitioners in the realization of the goals of the deferment of the judgement institution is important. We think that training activities should be carried out in this regard. Moreover, we believe that entitling the judge with more discretion in the determination of process of practicing, conditions and obligations of the institution will be beneficial for the achievement of the aim of benefiting the institution to the maximum extent. To be in this regard, the necessary legislation revisions should be performed immediately.
