Özet

This study focuses on conditions and effects of termination of financial leasing agreements executed between lessees and lessors for the purpose of financial leasing which is known to be one of the financing methods. Although the study is mainly based on the provisions of the Law on Financial Leasing, Factoring and Financing Companies no. 6361 (FFFL), it also analyses and discusses the differences between the repealed Law on Financial Leasing no. 3226 (FFL) and FFFL no. 6361 concerning termination as well as relevant doctrinal opinions and judicial decrees. The most controversial points of the study are analysed in chapter two and three. Chapter two deals with automatic termination of financial leasing agreements along with the effects of such termination while chapter three examines termination of financial leasing agreements by one of the parties and the effects of the relevant termination. Chapter one, on the other hand, attempts to clarify some of the fundamental issues which are considered to be connected with the termination indicated in chapter two and three including the concept of financial leasing, components of a financial leasing agreement and type of agreement in addition to the method to be pursued for registration and annotation of the agreement as a crucial point in case of any termination and continuous debtor-creditor relationship derived from the financial leasing transaction so as to provide a more specific picture of the matter.
