In the process of project development and effective implementation in urban conservation, transformation and development areas, the increase in project costs due to reasons such as the high concentration of existing settlements, high cost of real estate acquisition, multiple ownership shareholding patterns, search for economic rent by the owners, and high expectations from the projects as well as owners seeking to obtain economic rent adversely affects planning/project development implementation efforts. Particularly due to the high costs associated with urban services and real estate acquisition in conservation areas, central and local administrations do not seem to be willing to develop and implement projects in urban depression and conservation areas. The main reasons why the local administrations are not over-willed in such activities seem to be the long periods that are required to complete new planning and development projects to be carried out in protected areas because of inadequacy of resources and other reasons. In this study, the general framework of ownership and development rights was examined in the first place, practices of transfer of development rights (TDR) in selected countries and projects were evaluated, the need for TDR programs in Turkey was examined based on both legislative analysis and findings of field studies and solution suggestions about the applicability of TDR programs were put forward. In many countries, precedence is given to protection of areas with historic, cultural and natural significance; however, the types and application forms of protection differ from country to country. In addition to traditional methods such as expropriation, barter or exchange, prohibition of use etc., TDR programs have been implemented effectively in several countries since the 1970s as an innovative and alternative means of protection, and with these programs, it has been made possible for the owner to permanently forego some or all development rights provided and distributed with spatial planning, and if necessary, such rights can be restricted in accordance with planning decisions, and in return, by receiving ownership of rights in areas designated for new development, converting the granted rights certificate into cash and , if necessary, being used as securities. It has been observed unlike traditional tools, market mechanism, based on this planning, space utilization and protection tool based on market mechanisms, which differs from conventional vehicles, is particularly preferred for successful conservation practices of fertile agricultural lands, open and green areas, coastal areas, wildlife conservation areas, water basins, mineral resources and groundwater basins as well as archaeological, cultural, and urban protection areas. TDR programs were first introduced to the Turkish legal system with the amendment made to Law No. 2863 on the Protection of Cultural and Natural Assets, with Law No. 5226 dated 2004, through `the transfer of development rights` concept, and it should be underlined that there is no possibility of developing and implementing a successful TDR program, as in the examples of USA and Europe cases, with the current legislative arrangements were scarce. It has been identified that TDR programs can be utilized as a vehicle of protection for historical and urban sites, natural conservation areas, absolute agricultural areas, coastal zones, and prohibited military and security zones in Turkey. For a successful application, there is a requirement to reorganize the relevant legal regulations including the Turkish Civil Code No. 4721 and Building Code No. 3194 as well as the legislative arrangements related to the preservation of historical, cultural and natural areas in the first place, to restructure TDR implementation principles; implementation tools; the authorities with related rights and responsibilities; real estate, the right to development, and project appraisal systems; the appraisal authority; securitization, monitoring and evaluation systems will be required to make comprehensive arrangements for the functioning. In addition the rights, duties and responsibilities of real estate development and management specialists, who are supposed to play a key role in the work to be undertaken in this area, should be defined by legislative arrangements; the protection boards and the conservation-implementation units of municipalities should be restructured; the financing of protection should be covered by market-based tools; and awareness should be raised in different segments of society. Based on selected country practices, the results of legislative and needs analyses as well as the results of field studies in Turkey, successful development and implementation of TDR programs seem possible; however, effective implementation requires all stakeholders, particularly owners as well as professional organizations, legal experts and intitutions, planning, construction and real estate experts to be informed, and the duties and authorities of real estate development and management experts in the TDR markets should be well defined. Furthermore, there is a requirement to guarantee the future of bare ownership of real estate in the sending region by legislation, and no permissions should be granted for constructive activities for purposes other than protection in these areas in TDR program development activities. It should be emphasized that by the settlement of various legal and technical problems that may arise in practice in the framework defined in the research, TDR programs may enable successful implementation and solution of significant property and restriction problems in urban development and depression areas as well as rural and urban conservation works. In many cities, the legal and technical problems caused by the existing restrictions on private property in rural and urban areas for the purposes of identification of development areas, renewal of urban slum areas, urban conservation practices, protection of coasts, water resources, agriculture, pasture and environmentally sensitive ecosystems can be achieved through TDR programs. It is determined that it is possible to solve and make successful applications without any payment. It should be emphasized that all activities such as the development of TDR programs, program valuation, banking, project management and supervision should be carried out under the responsibility of real estate development and management experts.
