We are living in an era of rapid technological progress. Law is also influenced by the extent and speed of this progress. Changes in societal life caused by the speedy progress in technology renders the development of new notions and arrangements in law necessary. Personal data protection is one of such newly developing legal notions. Although personal data protection is new to the Turkish legal order, it is in fact already regulated in detail in the legal order of European Union (EU) member states. This study analyzes the authority of law enforcement bodies to collect process and evaluate personal data before and after a crime. Since data protection is not regulated as a separate heading under the Turkish legislation on law enforcement, the notion has been analyzed within the framework of the current nature and scope of the authority delegated to law enforcement bodies. The collection and processing of personal data have been analyzed both within the context of prevention of crime and the conduct of post-crime investigation. The regulation of law enforcement bodies? authority to collect, process and evaluate personal data in other countries and the jurisprudence of the European Court of Human Rights (ECtHR) on this issue form part of this analysis. Finally, the importance of DNA and DNA banks in the investigation of a crime as well as critical approaches on this issue have also been examined. The collection, processing and evaluation of personal data is regulated and protected through international law. However, such a regulation does not yet exist in the Turkish legal order. The impact of the lack of regulation on personal data protection has been thoroughly analyzed. This study argues that like in EU member states, the authority of law enforcement bodies to collect, process and evaluate personal data needs to be regulated as a separate heading under the Turkish legislation on law enforcement.
