In this thesis, philosophical foundations of the subject of human rights are dis-cussed within the framework of the views of Costas Douzinas. In an intellectual gro-und where `death of man` was declared, Douzinas claims that the liberal discourse returning to human rights and the 'subject' after the 1970s and especialley collapse of communism was theoretically problematic. What Douzinas reveals in his criticism is that the liberal discourse falls short of accounting for the functioning of human rights in the postmodern society and in a contradictory way to the discourse of human rights, it is responsible for the impasse in our era where the greatest human rights vio-lations have been witnessed. The subject of human rights is the product of modern philosophy and the me-taphysics of subjectivity that place human as the basis of meaning and value. But since the 19th century, critical philosophers have deconstructed this 'human', in other words the modern subject, and made them theoretically powerless. In this context, he puts a new conception of the subject, based on different intellectual resources, ins-tead of the liberal discourse that becomes theoretically untenable. In this context, he based his critique of the modern subject on Hegel and Lacan. The co-reading of He-gel and Lacan emphasizes that the subject is always 'intersubjective' and that rights will not make sense without the 'other'. This means a profound reversal of the liberal understanding that sees rights as a guarantee of individual desires and selfish de-mands. Douzinas' human rights subject makes the eternal responsibility to the other an founder ethical principle. In this context, the ontological scheme that emphasizes the intersubjectivity of human rights is completed with the Levinas' ethics of alterity.
