Özet

This dissertation with the title ?Systems Theoretical Approach to Law?, consists of the introduction, analysis and critic of the Systems theoretical approach of German jurist and sociologist Niklas Luhmann. According to this theory, the function of law is stabilization of normative behaviour expectations. Law, fulfills this function by its own communication that is made up of binary code: legal/ illegal. Law, differentiates itself from neighbouring systems like politics and economics with the help of this code and programs that evaluate the codes and it builds up a certain relationship weth the said systems that is called ?structural coupling?. Law, therefore is considered a closed system with respect to normative production whereas it is a cognitively open system. This quasi-open relationship results in production of law?s own elements and is called autopoiesis. The courts are in the center of the system due to their obligation to solve the cases before them. In the periphery are contracts, notaries and bars. Systems theory, analyses the legal system as a part of the society as a grand system and it aligns with the modern grandtheories against postmodern quests.
