The main purpose of this study is to examine how the subcontracting organization has influenced the union organization of workers and the negative factors that impede them to benefit from trade union rights. In addition, to identfy the problems that experienced by the subcontractor workers and find solutions to these problems are this study's purposes too. This study consists of four parts. In the first chapter, in order to get a better understanding the study, the relationship between Turkish worker and the union organization from past to these days was examined and the developmental process of the Turkish unionization of the Ottoman period was investigated. In the second part, in order of; reasons for the widespread sub-contracting that started to spread after 1980 were explained, with taking into consideration the history-legal process of this institution from the past to the present day the elements necessary for the establishment of this relationship were expressed, the terms of mutually responsibility and cheating were technically explained. Repectively in the third part; the relationship of the subcontracted worker with trade union were explained; union rights of the workers and subcontractor factors that hamper the unionization were expressed, the distribution of the subcontracted workers according to the sectors and the total number of the worker were determined. In the fourth chapter, in general; the structural problems of the subcontractor, in particular; the issue of unionization has been addressed and solutions for these problems were proposed. Literature scanning technique, which is a secondary data collection technique, was used in the study. Numerous resource books, articles, internet publications, periodical publications of trade unions, Supreme Court decisions, Official Newspaper, TBMM minutes and academic studies were utilized. However, we think that this study is not sufficient as a scope. Because the fragmented structure of the subcontraction by it's nature, the difficulty of being able to be registered, and the sectoral dispersal of the subcontractor's worker have limited the scope of the work and compromised the safety of trade union organization data.
