ABSTRACT The objective of this thesis is to bring to light the un-determined borders of the Caspian Sea and its reasons. When revealing these reasons, they were dealt with as a criterions. The scrutiny is based on the assumption of the possibility of Caspian border's determination via those criterions. The geographical characteristics of Caspian Sea expose the fact that it is to be perceived as a `lake`. The partition of the Caspian Sea into the sections is necessary due to the proximity of the natural resources of Littoral states. When we look at the legal processes pertaining to the Caspian Sea, after the break-up of the Soviet Union, the very unlawfulness and de-status quo were appeared as a reality. The misuse of the oil and gas pipelines by the littoral states are increased the chaos and disorder in Caspian Sea accordingly. In the atmosphere of uncertainty, disputes over an economical and political interests are occured among the littoral states and border disagreements arising from the natural resources appeared to be reflecting other fields. The Newly Independent States bordering with the Caspian Sea are started to get armed in order to protect their fields supposedly owned by them and comparingly, Iran is in a stronger position in terms of military power. Besides, Russia appears as the most powerful and dominant power in the Caspian region and she maintains this position with the manoeuvres. The International Sea Law treats the Caspian Sea as a `lake`; i.e. it supports the partition of the Caspian Sea according to the `median line` or `equidistance` principles. While the USA, Russia and Iran exert a powerful influence on the Caspian issue directly; China, Turkey and EU affect the whole process in an indirect manner. It is crucial to form the consensus and mutual understanding among the littoral states rather than applying one of the littoral states' thesis to the Caspian issue. As a conclusion, neither the application of the thesis of the littoral states of Caspian Sea nor the practice of the International Sea Law are important ; rather, the formation of the consensus which is applicable by the five littoral states, appears to be the most important point. The applicable thesis in Caspian Sea is `the partition of seabed and common use of the water surface` which is advocated by Russia, ratified by Azerbaijan and Kazakhstan, warmly welcomed by Turkmenistan and refused by Iran respectively. ill.
