The right of property is regulated under the title of ?Fundamental Rights and Duties? in our Constitution and it is protected with the Constitution. In Article 35 and 46 of the Constitution, it has been regulated that the administration can impose restrictions on private real estate properties only for the purpose of public interest and through the procedures stipulated by law. In other words, the confiscation of a private real estate property by the administration without complying with the procedures stipulated by law constitutes a case against the Constitution and Laws.It has been regulated that the administration can impose restrictions on proprietary right through expropriation in order to carry out public utility services. However, within the process the administration has started to confiscate private real estate properties without carrying out the expropriation procedures legitimized by the Constitution and arranged by the laws. Confiscation of private real estate properties by the administration for the sake of public utility services has brought the concept of confiscation without expropriation into light. The concept of confiscation without expropriation has manifested itself in our law system with the confiscation of private real estate properties, particularly for causes related with construction of roads. In case the administration confiscates an individual's real estate property without applying the procedures set forth in the Constitution and related laws, constructs a building or facility on that property or takes any steps against the usage right of the owner of the property through assigning the property to an utility, it is considered that the administration have confiscated the property in question without expropriating it.The initial regulations regarding confiscation without expropriation have been made through jurisdictional decisions. With the Supreme Court's Decision of Joint Chambers regarding the two judicial opinions of 11.05.1956, Docket 1, Decree numbers 6/7, it has been stipulated that the property right of the proprietor whose private property is confiscated without expropriation does not cease and that the proprietor may negate the administration's unjust action through filing a possessory action, or by waiving its such right of filing an action, may transfer the ownership of the confiscated property to the administration and claim the monetary remuneration of the transferred property, and that such claims shall not be subject to any time limitation. In the length of time, the solution brought in by means of Supreme Court practices has caused problems. Therefore, some legal regulations have been made.According to the law numbered 221 of the date 05.01.1961, all cases of confiscation without expropriation until the date of 9 October 1956 have been accepted as legally valid expropriations, and consequently no case of confiscation without expropriation committed before the mentioned date have been left in question.By means of the 2942 numbered Expropriation Law, confiscation without exportation has been subjected to a legal arrangement.According to the 38th article of the 2942 numbered Law, the indefinite right of filing actions vested by the Supreme Court to the proprietors whose properties are confiscated without expropriation, have been subjected to a limitation of time of twenty years. Due to this limitation of time (statutory limitation), cases that are not filed within this limitation can no longer be initiated.Confiscation without exportation, to which a legal basis is established under Article 38 of the law numbered 2942, results in a set of consequences for both the proprietor and the administration. The right of the proprietor to file claims based on its property right is the main result brought in by the action of confiscation without expropriation. Possessory actions, on the other hand, are the most prominent type of such claims. As the proprietor of the real estate may claim the cancellation of the confiscation through a possessory lawsuit, it may also chose to consent to the transfer of its ownership to the public entity and make a claim for the payment of the price of the real estate. In addition, the proprietors or possessors who suffered damages due to the confiscation without expropriation may claim the administration to compensate such damages. Also a legal interest, if claimed, may be adjudged in the lawsuits filed for remuneration or compensation due to confiscation without expropriation. The beginning date of interest shall be the date of initiation of the relative case of remuneration or compensation. The most important consequence of confiscation without expropriation, from the perspective of the proprietor, is the cessation of property right.Confiscation without expropriation brings in some consequences also in respect to the administration. Furthermore the most important is the obtainment of the ownership of the property the administration has confiscated without expropriation. In addition, the administration may plead in the cases filed against that it has carried out expropriation or paid the relative remuneration, or it has confiscated the property pursuant to a provision of law, or may render its action legally justifiable by expropriating the property it has confiscated without expropriation after the lawsuit is initiated.Due to the fact that Article 38 of the Expropriation Law is invalidated by the Constitutional Court with the grounds of its unconstitutionality, the statutory limitation of twenty years stipulated by Article 38 no longer applies.Since the subjection of property right, among the fundamental rights, to a statutory limitation of 20 years, under the Expropriation Law numbered 2942, constitutes a case of unconstitutionality, its invalidation has exhibited the necessity of being a Constitutional State. In this way, rendering the unjust interference to property right, which is protected by the Constitution, legally justifiable by means of a statutory limitation is prevented.
