ABSTRACTFrom the establishment of Ottoman Empire, sharia and customary legal system was practiced. This systemis based on the traditional Islamic law and the courts decided by a single judge. Outside the field of application of Islamic law, there were also assemblies of commerce that multiple members decided unanimously or by a majority vote. In these councils there were also members representing foreign states. Starting from the first half of 19th century, in the face of challenges caused by the increasing commercial relations with Western countries, requirement of making new arrangements was born. Essentially the establishment of commercial courts based on before the era of Tanzimât, it means that this construction was made in the beginning of 19th century. Increasing the trade with Europe, necessitating the knowledge of Western customs and due to inadequate care for this type of business cases by the judges who lack largely this skill for the first time a commission was set up in the Custom Office in 1215 (1800-1801). This commission left its place to the Trade Council which was established within the Ministry of Commerce in 1838. These councils had some modifications in 1847. When the entry into force Code of Commerce in 1850, French Commerce Code gradually begun to cite and this process continue with the code which provide the establishment of Commercial Courts and Procedural Law of Trade Proceedings in 1861 and The Law of Maritime Trade which came into force in 1863.In cases involving a conflict between foreigners and locals, consulate or embassy which are related to this foreigner sent to two alien members and a interpreter to be ready in the court.According to Decree of Justice, published in 1875, commercial courts and Court of Appeal which were dependent to the Ministry of Commerce until that day, attached to the Ministry of Justice.Commercial Courts in Istanbul was divided into three departments with The Law of Court Organization, dated 1879.The establishment of Commercial Courts is the first sample of the appearance of modern justice organization which has secular character. However, it should be noted that some of the elements, contained particularly in the structure of the Commercial Courts, has led to drawbacks. From the beginning, in a consequence of taking the merchants in the nationality of foreign states as a member of these courts, foreign governments saw it a kind of entitlement. On the abolition of capitulations with imperial decree about abrogation of foreign privilege in 8th September 1914, the First and the Third Offices of Commercial Court in Istanbul which had mixed mission, has gone away.

ÖZETOsmanlı Devleti'nde kuruluştan itibaren şer'i ve örfi hukuk sistemi uygulanmaktaydı. Kanûnnâme-i Ticâret'in 1850'de yürürlüğe girmesiyle Fransız Ticâret Kanûnu'nun aşama aşama iktibası süreci başlamış, bunu 1860'ta Ticâret Mahkemeleri'nin kurulmasını sağlayan kanun, 1861'de Usûl-ı Muhâkemât-ı Ticâret Nizâmnâmesi ile 1863'te yürürlüğe giren Ticâret-i Bahriye Kanûnnâmesi izlemişti.
