Özet

Space Law, a sub-discipline of International Law, has emerged with the development of space technology in the 20th century. The legal status of the outer space is shaped by international treaties and UN General Assembly resolutions adopted by the UN. At the beginning of the Space Age, state sovereignty was first discussed in space and on celestial bodies. In time, the development of technology and the participation of new actors in space activities required us to consider the legal status of outer space in terms of property rights. In the order created by outer space treaties, outer space is organized as an international space that is not subject to the sovereignty of any state. With the development of technology, increase the possibility of access to outer space and the discovery of the worthwhile space's resources, states began to interpret the regulations of Space Law in line with their interests and private individuals began to claim property rights in space. In this thesis, it is aimed to examine the state sovereignty and property problem in outer space, which is one of the basic problems of Space Law, in the context of contemporary technological developments and discussions in doctrine and to evaluate the need for reformation by pointing to the uncertainties about property rights in space law.
