The union freedom means the freedom of the employees and employers to organize freely to safeguard and protect their common economical rights and benefits in the professional life. Within the scope of the said freedom, first and foremost, the individuals have the right to establish unions, to become members of unions and to participate in union activities. On the other hand, it should also be considered within the scope of the union freedom not to become a member of any union and to leave union membership. However, the employees should be free from all kinds of oppression and intimidation in order to benefit from the rights, which the union freedom entitles to them. In the application, termination based on union related reasons shows up as the most important threat that violates the union freedom.Termination due to union related reasons means the dismissal of an employee for reasons of establishing a union or becoming or not becoming a member of a union or participation in union activities or quitting the union, which he/she is a member of. Having the concern of becoming unemployed under the threat of dismissal from job, the employees give up the union freedom. For this reason, it is essential to protect employees against termination of employment contract due to union related reason.Within the context of the Turkish legislation, termination of employment contract due to union related reasons constitutes a violation of Article 51 of the Turkish Constitution that secures the union freedom and Article 22 of the Unions Law. On the other hand, Article 30 of the Unions Law incorporates special provisions related to the termination of employment contract of workplace union representatives due to representation activities, while Article 31 thereof stipulates that the employment contracts of the employees cannot be terminated due to union membership or union activities. As per the said legislations, it can be specified without any doubt that termination due to union related reasons is a type of termination that contradicts the law. As a matter of fact, termination due to union related reasons constitutes an invalid termination for employees under employment guarantee and abusive termination or wrongful termination for those not under employment guarantee. Additionally, the termination due to union related reasons constitutes the crime of preventing the use of union rights under the provisions of article 118 of Turkish Penal Code and is subject to penal sanctions in addition to legal sanctions.
