ABSTRACTIt is required primarily to identify how and by whom the crime is committedand to collect evidence in order to reveal a crime. In case of organized crimes, organizational structure should also be detected as well as collecting evidence. Therefore, fighting against organized crimes has always been more complex anddifficult compared to that of individual crimes. However, it is not enough to taketraditional protection measures to overcome this challenge anymore. Thus, it requirestaking some confidential protection measures. One of these confidential protectionmeasures is to assign a confidential investigator. Appointing a confidentialinvestigator is a regulation firstly stated in legal terms in the Law no. 4422 onFighting Against Interest-Oriented Crime Organizations. When this Law wasabolished, a similar regulation under the title of `Appointing ConfidentialInvestigator` was put into practice in the Law no. 5271 of Turkish CriminalProcedure Code, Article 139 within the scope of activities stated by the judicialpolice. However, this regulation was criticized in many aspects in terms of itsdoctrine and judicial decisions. In this study, we have made several examinationsconsidering these criticisms. Our thesis is composed of three sections. In the firstsection, the core of the notion of confidential investigator as well as other similarterms were addressed and then the purpose and legal character of the confidentialinvestigator were discussed. In the second and third section, within the framework ofArticle 139 of Turkish Criminal Procedure Code, some explanations for on whatconditions and how measures are applied, what problems may arise when it isapplied and what should be done to overcome these problems were stated. Differentpoint of views from the doctrine in these explanations were benefitted. Moreover, several examples of decisions made by the Turkish jurisdiction and foreign judicialbodies in order to better grasp the problems faced in the application were presented. Thus, an extensive analysis on the institution of appointing a confidentialinvestigator playing an important role in fighting against organized crimes within theframework of material law in consideration of both the doctrine and the applicationwas carried out. Keywords: Organized crime, appointing confidential investigator, confidentialofficial, Turkish Criminal Procedure Code, confidential protection measures.
