ABSTRACTThe most important factor in the decision making process of a judge isthe evidences submitted by the parties in order to prove the facts on whichthey grounded their claims or counter-arguments. It has been tried to beevaluated both in theory and practice, that by which party and when suchevidences would be submitted, by the judges and jurists since the Romanjurisdiction. There existed different jurisdiction systems in different periods, inRoman Empire. The jurisdiction system, which has been generallydesignated as ?Ordo ludiciorum Privatorum? which means ?Private CourtsSystem? in English and which had been applied in two different forms as?Legis Actiones? in ancient era and ?Formula? in classical law period, wascomposed of two stages. The exercise of jurisdiction was beginning with the?In lure? stage which was occuring before a Magistra who was a civil servant, and then it was continuing with the ?Apud ludicem? stage which was before?ludex Privatus? who was a private judge. This document was created by the trial version of Print2PDF. !Once Print2PDF is registered, this message will disappear.!Purchase Print2PDF at http://www.software602.comThere is no rational evaluation related to the concept of onus probandi-in English; burden of proof- because of the ceremonial and religiousstructure of the Legis Actiones system. However, it is possible to find somegeneral principles which were used in practice in this period, altough they arenot written. For instance, in Legis Actiones Sacremento in Rem the partieswere oliged to prove the claim of ownership mutually, or in Legis ActioSacramento in Personam, the suitor who had a creditor claim had to provehis claim.Notwithstanding, in the classical law period the jurists focused on theconcept of burden of proof and tried to establish general rules. There arethree general and basic rules in the sources remained until today as ?burdenof proof is on the suitor, claimant?, ?the defendant who carried out anexceptio, was obliged to prove its basis? and ?It is possible to prove positivefacts, it is not possible to prove the negative ones?. However, since the ?apudiudicem? stage, in which the case was examined, was performed by privatejudges who had been selected among the people who were not jurists, andsince the judges could develop their opinions independently, without a rulebinding them. Besides, there was no sanction against a judge who did nottake into consideration the burden of proof rules when making his decision. This document was created by the trial version of Print2PDF. !Once Print2PDF is registered, this message will disappear.!Purchase Print2PDF at http://www.software602.comIn the ?Cognitio Extra Ordinem? the last system applied in RomanEmpire which is acknowledged as the origin of contemporary jurisdictionsystems, it is noticed that the state interferes the jurisdiction process. Thejurisdiction is performed by the civil cervants in state hierarchy. Theseassigned judges were bound to the laws and regulations of the emperor, theyconfronted with the sanction of their judgment to be rendered invalid, whenthey decided against the law. In this period, ıt is seen that the rulesestablished by the jurists of the classical period about the burden of prooftook place in the regulations issued by the emperors and in the systematicsources. As a result, in the historical process, the importance of the concept ofburden of proof ?onus probandi? in jurisdiction has been noticed and for thesake of reaching a fair judgement both in theory and practice, general andbasic principles of this concept have been formed. This document was created by the trial version of Print2PDF. !Once Print2PDF is registered, this message will disappear.!Purchase Print2PDF at http://www.software602.com.

Ancak budönemde yazılı olarak var olmasa da uygulamada kullanılan birtakım genelThis document was created by the trial version of Print2PDF. !Once Print2PDF is registered, this message will disappear.!Purchase Print2PDF at http://www.software602.comilkelere rastlamak mümkündür. Yargılama, başından sonuna kadar devlet hiyerarşisinde görev yapanThis document was created by the trial version of Print2PDF. !Once Print2PDF is registered, this message will disappear.!Purchase Print2PDF at http://www.software602.commemurlar tarafından gerçekleştirilmekteydi. This document was created by the trial version of Print2PDF. !Once Print2PDF is registered, this message will disappear.!Purchase Print2PDF at http://www.software602.com.
