Özet

Although Ibn Qayyim has a Hanbalī-oriented jurisprudence, he accepts the salafī tradition as a reference. Thus he defends the position that there are two sources of shar'ī provisions, one of which is the Qur'ān and the other is the Sunnah, and the other shar'ī proofs (al-adilla al-shar'iyya) rests on these two. He accepts qiyās as comes after the Qur'ān, the Sunnah and the words of the Sahāba in the hierarchy of the proofs, only in status of necessity. There are two principle opinions underlying Ibn Qayyim's thought of qiyās who associates qiyās as a method with jurisprudence of ijtihād al-ra'y which is a method of rational deduction (istinbât) during the Prophetic Age, sahāba and tābiūn periods: canonical texts (nass) includes all the sharī'a rulings and there is no contradiction to the qiyās in the sharī'a law. And the reflections of these two principles show themselves clearly in his definition and classification of qiyās, and in the stage of proofing the authority (hujjiyyah) of qiyās.

Hanbelî mezhebi ekseninde bir fıkıh anlayışına sahip olmakla birlikte selefî geleneği referans kabul eden İbn Kayyim, şer'î hükümlerin Kur'ân ve Sünnet olmak üzere iki kaynağının olduğunu ve diğer delillerin bu iki asla dayandığını savunmakta, şer'î deliller hiyerarşisinde naslardan ve sahâbe kavlinden sonra yer verdiği kıyas metodunun kullanılmasını ise zaruret halinde kabul etmektedir. Kıyas metodunu asr-ı saâdet, sahâbe ve tâbiîn dönemlerinde kaynaklardan hüküm çıkarmada başvurulan aklî istidlal yöntemlerinden re'y içtihadı ile ilişkilendiren İbn Kayyim'in kıyas düşüncesinin temelinde, nasların şer'î hükümlerin tümünü ihtiva ettiği ve şeriatta kıyasa aykırılığın olmadığı düşünceleri yer almakta ve bu iki temel prensibin yansımaları onun kıyası tanımlamasında, taksiminde ve kıyasın hucciyetini delillendirmesi aşamalarında kendisini açıkça göstermektedir.
