Özet

This study is based on the local governments. Which are understood as the basis of the democracy. Elections are the key mechanism for any walking democracy. The basic headstones of the local elections are local democracy, participation right and justice. Ideal local election system must rely on these headstones.Municipality is the most important and basic prospect of local government. Local election system of Turkey is proportional represantation system with D'Hondt method and election thereshold by tenth. We have studied the basic constitutional law question in this dissertation; in which we have discussed why and on what grounds the Turikish municipal election system is contrary to democratic participation and fair represantation. The election system most suitable for municipalities in terms of democracy, justice and participation right must be proportional representation election system that consists of two ballots for mayors. Within the context of local election law, the one-tenth election threshold applied in municipal assembly elections is contrary to fair represantation principle. We have examined Turkish municipal election system in the last section of the dissertation from normative critical legal perspective.
