Bills of exchange are regulated under the names of letter of exchange, bill to order(bond) and check with a title of ?Bills of Exchange? in the fourth chapter of the third book ofTurkish Commercial Code, between articles 582-735. The law maker preferred using the wayof expression based on the letter of exchange and was content with making references toprovisions regarding the letter of exchange after having stated differences between bond andcheck. It is observed that the same situation keeps on in the new Draft Turkish CommercialCode.Prescription studied through the thesis has dropping feature and on condition that apayee of any bill of exchange does not demand his right within time and conditions envisagedin the Code, he is deprived of effective judicial protection, in other words of obtaining hisright by means of a lawsuit. Thus the right which is under prescription becomes not to becollectable without the consent of his debtor. The topic of prescription in bills of exchange is regulated detailed differently fromcommon bills by comparison with the letter of exchange, bond and check because of trust, fluidity and quickness the bills of exchange provide, and easy use of them instead of cash andbeing excess. If it is necessary to summarize the prescriptions in the bills of exchange, they aresubject to six-month, one-year, three-year and ten-year prescription duration which isdefended as a rule but has not got any ability of practice according to an İBK, and in additionthis under Article 856 of Turkish Civil Code, Article 105, 143, 194, 289 and 251 of Law ofExecution and Bankrupt we can state that it is completely out of the content and provision ofprescription. After three years from redemption date, lawsuits against person accepted the police;after one year from protest date or the end of redemption date if there is a note of ?to bereturned without any expense?, lawsuits holder sues against endorsers and a drawer; after sixmonths from the date a endorser paying the letter of exchange or from the date the letter ofexchange is claimed against him in a lawsuit, lawsuits the endorser sues against otherendorsers and the drawer undergo prescription (Art. 661 of TCC).Regarding prescription period on the bonds, the law is contended with a reference toprovisions about the letter of exchange (Art. 690 of TCC). According to these provisions, since the person who draws up a letter of exchange is liable like the person who accepted theletter of exchange (Art. 691/1), after three years from redemption date, lawsuits against adrawer who is the primary debtor of the bond; after one year, a holder?s rights to apply toendorsers, an endorsee and the people who has given guarantee on the bond in favour of them;after six months, the rights of the endorsers who have paid the sum of the bond to apply toone another undergo prescription.Prescription period in checks are set very short and on the contrary to the otherslawsuits a holder brings against a drawer or application debtors, or lawsuits an applicationdebtor who has paid the sum of the cheque brings others are subject to six-month prescriptionperiod (Art. 726 of TCC).To change the prescription period is not possible since it is related to public orderexcept that legislation orders it differently. The prescription periods mentioned before are cut off because of bringing suit, execution request, notifying the lawsuit or informing insolvency table of a claim (Art. 662 ofTCC). It is not possible to complete the causes of the prescription which are in restrictednumber and can not be expanded with the causes in Obligations Law (OL) or to apply generalprovisions. The cause cutting the prescription period affects only whoever regarding it hasmaterialized (Art. 663/1 of TCC). So this situation is exactly opposite to the rule of whollycutting off (Art. 134 of OL). The reason for this is the principle of independence of signatureswhich is accepted in valuable documents law (Art. 589/1 of TCC).When calculating the prescription period, holiday days are not taken intoconsideration. If redemption date is a holiday day, payment is only demanded the first workday that follows the holiday day (Art. 664/1 of TCC). Besides, when calculating the periods, the days that they start are not taken into account (Art. 665 of TCC).When the prescription has been cut, duration passed until that time is abolished and anew prescription period emerges having the same duration with the previous one (TCC.663/2).Despite the fact that Turkish Commercial Code does not include any provision aboutceasing the prescription period, in case of emergence of the circumstances provided in Article132 of Obligations Code, there would not be any inconvenience in implementing theprovisions taking place in this code about ceasing. The prescription can not be taken into consideration by tribunal without any demandabout this issue. Despite the fact that it is not one of the principal objections regulated inArticle 187 of Turkish Civil Procedural Code, it must be put forward together with the replyto the basis of the case at the latest. Against the objection of prescription made after that timeby a party of the case, the other party would have the right to claim the extension of the case.It is possible for the debtor to renounce from his claim after the prescription hasrealized (Art. 139 of CO).A bill of exchange which is subject to prescription can not stay in force as an ordinarybill of dept. It can only be considered written evidence commencement.Despite the fact that theoretically all claims are subject to prescription, in some cases, debts stemming from bills of exchange would not be subject to it (due to hypothec of realproperty or personal estate, having insolvency receipt, initiating of bankruptcy process andconcordat).A holder can bring a suit against a payee because of unjust enrichment, depending onthe main contractual relation between them. But this file will have an extraordinary statusapart from the ordinary unjust enrichment regulated in Obligations Code (Art.644 of TCC).Under Turkish International Civil Law (TICL), the prescription is accepted in thestatus of a verdict (Art.7 of TICL).Except for the special provisions of the TCC, about which we have tried to makeexplanations, to the prescription of bills of exchange cases are applied related provisions ofOC (Art.1 of TCC). Turkish Commercial Code, as explained above, determines only suchpoints about prescription the claims stemming from the bills of Exchange as various deadlinestaking place in the process, beginning dates of these deadlines, causes of their cut and resultsof their cut. The other issues about prescription process have not been mentioned.
