Turkish Criminal Law mentions some offences which are the offences against the persons in the second part and against the life in the first term and these are regulated under second book of special provisions. One of them is involuntary manslaughter. In this paper, involuntary manslaughter formed in the article 85 of TCL is observed. This study will be assessed in two diverse parts. In the first part, the issue of negligence will be mentioned. Our explanation will be supported with the case law in necessary situations. In the second part, the involuntary manslaughter which is our essential topic will be assessed carefully in terms of the code. Also in important situations of this part, the views and aspects of implementations will be observed by benefiting from case law.The concept of negligence (taksir) was derived from the origin of the root of `kusur? which is an arabic word and this word means that not doing something when it should be done.On the other hand, according to legal definitions, negligence is that to behave without foreseing the outcomes of an offence whose elements are regulated in the codes by not obeying the responsibility of attention and pain, and it is called unintentional negligence. Although the person forsee the outcomes and does not want it to occur, if it occurs, this is called as intentional negligence. (Article 22 TCL)To idendify a person?s action as an involuntary manslaughter, normally, the provisons of negligence have to occur. In terms of this fact, the action has to be able to cause an offence which can be committed with negligence ( the offence of involuntary manslaughter), this has to be voluntary, but the outcome is not voluntary, there has to be contradiction against the responsibility of attention and pain, the outcome has to be foreseen and lastly there has to be causality link between the action and the outcome. As a conclusion, we can assess the involuntary manslaughter with the points; The involuntary manslaughter is regulated under the article 85 of Turkish Criminal Law. According to article 85/1; the person who brings about to kill another with negligence is sentenced imprisonment from two years to six years.According to article 85/2 of TCL, if a person causes the death of more than one person or additionally causes one injury or more than one injury, this person sentenced imprisonment from three years to fifteen years. The code contains the special provision term in second clause of article 85, which is related the offence of involuntary manslaughter. In this clause, two special provision terms are regulated; these are a) the action causing more than one death and b) the action causeing not only one or more death, but also more than one injuries. In these provisions, the sentence for the agent is imprisonment from two yers to fifteen years.Eventually, we need to clarify that in the involuntary offences, the outcome is not a condition of penalizatation, but it is an essential condition of the offence. Therefore, the involuntary manslaughter is completed when the outcome occurs, not in the time the action occurs.
