Since its establishment, the Ottoman State has established a legal order known as'Ottoman law' by creating a unique procedure through the general bases of Islamiclaw, rather than creating a law from scratch. The sources of Ottoman law also bearresemblance to Islamic law. The Qur'an, Sunnah and icma act directly as the mainsources of Ottoman law. The jurisprudence of the jurists shows fer as a source in areaswhere the primary sources do not regulate. In addition, there are some helpful sourcesthat help the functioning of the law and provide theoretical and practical information. These are books of fiqh, canons, Shar'iyya records and fatwas. The fatwa authorityhas a special position within these resources. When the fatwas issued by the mufti arepresented to the case, they can change the provision by influencing the Kadis, andsometimes they can bring a dispute to a conclusion without becoming a case. Theeffects of the sheikhulislam fatwa are more general and have consequences that couldaffect the whole of the country. In the capital, the fatwa Authority, which offers ascientific window into the city about the conflict between the two people, providesthe state authorities with an effective and direct legal opinion on issues such as war, peace, political murder and Sultan Hal'i. It is also possible for the fatwa text to gainthe power of law by an edict issued by the Sultan, and there are many examples inthis regard. In the thesis, the position of fatwa among the sources of Ottoman law, itsimportance and influence within the legal system will be investigated and explainedthrough examples. The thesis is intended to show the relativity of fatwa as a source inOttoman law.
