Özet:

There are many statements about the importance of woman and children in Islamic religious and legal texts. Naturally, women and children are especially valuable for the Ottoman Empire, which adopted Islamic law. On the other hand, the proclamation of Tanzimat led to important changes in Ottoman law and the concept of child was included for the first time in the 1858 Penal Code. Another issue that makes this legal regulation important is that the crime of sexual abuse committed against the child is clearly stated and the child is protected within the legal context. Thus, with the penal code, the existence of the child in the legal dimension in social classification has been made visible. In this study, the crime of sexual abuse committed against a child in the Ottoman society will be discussed and the societys perspective on the child and the changing position of the child with the 1858 Penal Code will be explained. In this context, child abuse cases that are reflected in the courts and are the subject of complaints will be tried to be revealed in line with archival documents.
