 Due to the need to adapt Directive 85374, which entered into force forty years ago, to the conditions of the digital age and the circular economy, a very comprehensive revision was made on Directive. As a result, the New Product Liability Directive 20242853 entered into force on December 9, 2024. With the new regulation, software has been included in the scope of the product, free and open source software is excluded from the scope, situations where the manufacturer has control over the product have been regulated, amendments have been made in favor of the injured party regarding the distribution of the burden of proof and the disclosure of evidence, the circle of liable persons has been expanded, and the types of damages to be compensated have been increased by removing the maximum and minimum limits for damages. In addition to such fundamental amendments, many other amendments have been made. As is the case in the European Union countries, Turkish law also needs to be harmonized with the New Product Liability Directive within the scope of harmonization with the European Union law. In this study, explanations and evaluations will be made on software as a product, control of the manufacturer, distribution of the burden of proof and disclosure of evidence, the circle of liable persons, and the scope of damages, which are fundamental for the Directive.

 Avrupa Birliği hukukunda, kırk yıl önce yürürlüğe girmiş olan 85374 sayılı Direktifin dijital çağın koşullarına ve döngüsel ekonomiye uyarlanabilmesi gerekliliği nedeniyle, Direktif üzerinde oldukça kapsamlı bir revizyona gidilmiştir. Bunun sonucunda 20242853 sayılı Yeni Ürün Sorumluluğu Direktifi 9 Aralık 2024 tarihinde yürürlüğe girmiştir. Yeni düzenleme ile yazılım ürün kapsamına dahil edilmiş, özgür ve açık kaynak yazılımlar kapsam dışı bırakılmış, ürün üzerinde imalatçının kontrolünün bulunacağı durumlar düzenlenmiş, ispat yükünün dağılımı ve delillerin açıklanması konusunda zarar gören lehine değişiklikler yapılmış, sorumlu muhatapların çevresi genişletilmiş, zarar için azami ve asgari sınırlar kaldırılarak tazmin edilecek zarar türleri artırılmıştır. Bu gibi esaslı değişikliklerin yanında daha birçok hususta değişikliğe gidilmiştir. Avrupa Birliği ülkelerinde olduğu gibi Türk hukukunda da Avrupa Birliği hukukuna uyum amacı kapsamında, Yeni Ürün Sorumluluğu Direktifine uyumlu düzenlemeler yapılması gerekmektedir. Bu çalışmada Direktif için temel nitelikte olan; ürün olarak yazılım, imalatçının kontrolü kavramı, ispat yükünün dağılımı ve delillerin açıklanması, sorumluların kim olduğu, zararın kapsamı ile ilgili açıklamalar ve değerlendirmeler yapılacaktır.
