Özet:

The scope of international protection includes individuals who meet the refugee definition envisaged in the 1951 Geneva Convention Relating to the Status of Refugees 1951 Geneva Convention or, even if they do not meet this definition, are in need of international protection due to being unable to benefit from national protection. While protection is provided through refugee status for those meeting the 1951 Geneva Conventions definition, individuals who do not meet the definition but are entitled to international protection receive it under complementary protection statuses, such as subsidiary protection. In this context, the existence of a separate temporary protection regime may lead to certain misunderstandings regarding the nature of the protection provided to individuals under temporary protection. This article seeks to demonstrate, through theoretical discussions and an examination of selected court decisions, that while the provision of international protection through a temporary administrative mechanism may introduce flexibility in delivering certain rights and services, it does not alter states obligations under the principle of non-refoulement.

Uluslararası koruma kapsamına 1951 tarihli Mültecilerin Hukuki Durumuna Dair Sözleşmede 1951 Cenevre Sözleşmesi yapılan mülteci tanımına uyan veya bu tanıma uymasa bile ulusal korumadan faydalanamadığı için uluslararası koruma ihtiyacı içerisinde bulunan kişiler girmektedir. 1951 Sözleşmesindeki tanıma uyan kişilere koruma, mülteci statüsü üzerinden sağlanırken, tanıma girmediği halde uluslararası korumayı hakeden kişilere koruma, ikincil koruma statüsü gibi, tamamlayıcı koruma statüleri üzerinden verilmektedir. Bu durumda, ayrıca bir geçici koruma rejiminin varlığı, geçici koruma kapsamındaki kişilere sağlanan korumanın niteliği bakımından bazı yanlış anlaşılmalara sebep olabilmektedir. Bu makale, uluslararası korumanın geçici bir idari mekanizma üzerinden sağlanıyor olmasının bazı hak ve hizmetlerin sağlanması konusunda esneklik getirebilse de, devletlerin geri gönderme yasağı kapsamındaki yükümlülüklerini değiştirmediğini teorik tartışmalar ve seçilmiş mahkeme kararlarının incelenmesi yoluyla ortaya koymaya çalışmaktadır.
