Özet:

When states emerged, they took over the powers of administration and dispute resolution. This time, the problem of resolution of conflicts between states came to the fore and states had to solve some of their problems that they could not solve through war. The instinct of the states to protect their rights has created armies. It revealed that the army as a public service unit and the proceedings to be held in this context should be bound to the law rules. The aim of the study is to evaluate replacing the military judiciary with the duties and powers of military courts, as a result of the Constitutional amendment dated 2017, and the amendments made by Law No. 7329 in this process in the light of legislation and judicial decisions. For this purpose, necessary analyzes were made by scanning the necessary literature, legislation and judicial decisions, accompanied by the descriptive scanning model, which is one of the qualitative research methods. As a result, it is seen that changes by the amendments made with the Law No. 7329 such as clarification of the procedures regarding the trial of military persons by the civilian judiciary, the introduction of various new legal guarantees for individuals, and the inability of the administrative authorities to intervene in the judicial authorities are beneficial for the state of law.
