Özet:

Siyasah Sharʿiyyah is a method utilized in some legal systems, granting political authority the power to issue rulings on matters lacking explicit evidence. However, the lack of conceptual clarity surrounding its content has led to the emergence of various approaches to the term of siyasah throughout history. Currently, efforts are underway to expand this concept as a legitimate foundation for addressing certain problems. To define the boundaries of siyasah sharʿiyyah, clarifying the conceptual ambiguity surrounding it proves helpful. This study aimed to determine the areas of application of siyasah sharʿiyyah within the Ḥanafi madhhab of thought. The definitions provided for the concept of siyasah sharʿiyyah in the Ḥanafi madhhab were analyzed, along with the conditions derived from these definitions and the practical examples related to them. As a result of this analysis, it became clear that the Ḥanafi madhhab subjected siyasah sharʿiyyah to specific conditions that distinguish it from other methods. Accordingly, only actions undertaken by political authority were included within the scope of siyasah sharʿiyyah. However, not every action undertaken by political authority was considered part of siyasah sharʿiyyah. The Ḥanafis utilized siyasah in the sense of discretionary punishment tazīr, deterrence, and reprimand, while actions lacking these aspects were excluded from the scope of siyasah sharʿiyyah. For this reason, the majority of examples related to siyasah appeared in the field of penal measures. When examining the conditions and situations specified by the Ḥanafis, it became evident that expanding the boundaries of siyasah sharʿiyyah at least within the framework of the Ḥanafi madhhab is theoretically limited.

Siyaset-i şeriyye, siyasi otoritenin hakkında açık delil bulunmayan bazı konularda hüküm verme yetkisi olması açısından bazı hukuki düzenlemelerde kullanılan bir yöntem olmuştur. Bu inceleme sonucunda Hanefi mezhebinin siyaset-i şeriyyeyi diğer yöntemlerden ayıracak bazı şartlara tabi tuttuğu görülmüştür.
