Özet:

One of the Sharīʿah objectives of marriage is to ensure tranquility and happiness among spouses. The realization of this goal is contingent upon the mutual approval and compatibility of prospective spouses khātib and makhtūba. To facilitate mutual approval and harmony, Sharīʿah encourages prospective spouses to have a modest glance at each other before entering the marital contract. Sharīʿah prohibited the act of gazing between unrelated members of the opposite gender under normal circumstances. However, in specific cases, within defined limits, this act of gazing has been deemed permissible. Intending to marry falls within these exceptional circumstances. From the perspective of fiqh, it is considered permissible for non-mahram unrelated men and women without a marital contract to glance at each other, based on necessity and a critical need. Evaluating a prospective spouse is similarly regarded in this context. Fuqahā have outlined certain conditions for the permissibility of such glances between khātib and makhtūba. While there is consensus on the intention of marriage and avoiding fitnah and seclusion, there is disagreement on the conditions such as getting permission from the makhtūba and avoiding lust. This paper aims to delineate the Sharīʿah limits of gazing between khātib and makhtūba based on the perspectives of different Islamic sects. It seeks to provide guidelines for lawful and measured interactions for individuals during the marriage process.
