 This study aims to determine what regulations on disadvantaged groups include in the Labour Law and how these regulations are reflected in the labour market and to identify whom the disadvantaged groups include under the national and international literature, which regulations regarding them are included in the Labour Law, and how relevant provisions shape labour market through the 2020 Household Labour Force Survey Micro Data Set HLFSMDS published by the Turkish Statistical Institute. The disadvantaged individuals can be grouped as women, childrenyouth, elderly, disabled peopleex-convictsterror victims. This study with quantitative research method tested whether there was a statistically significant difference between the variables using independent samples t-test and chi-square analyses. The analysis results indicated that women earned less wage income than men in violation of legal regulations; however, they were employed at underground and underwater jobs to a limited extent. Approximately 40 of child labourers were working over 45 hours per week in violation of the legislation. Most of individuals aged over 65 were self-employed and working unregistered in the agricultural sector. Another disadvantaged group was the disabled people, ex-convicts, and terrorism victims; however, due to the limited data on the employment of this group in HLFSMDS, it was not possible to conduct a statistical analysis, and the relevant group could only be evaluated based on this law.

 Çalışmanın amacı, İş Kanununda dezavantajlı gruplara yönelik düzenlemelerin neleri içerdiğini ve bu düzenlemelerin işgücü piyasasına nasıl yansıdığını tespit etmektir. Bu amaçtan hareketle, öncelikle ulusal ve uluslararası yazında dezavantajlı grupların kimleri kapsadığı ve İş Kanununda bu gruplara ilişkin hangi düzenlemelerin yer aldığı ortaya konmakta; sonrasında ilgili hükümlerin işgücü piyasasını nasıl biçimlendirdiği Türkiye İstatistik Kurumu 2020 yılı Hanehalkı İşgücü Anketi Mikro Veri Seti HİAMVS aracılığıyla saptanmaya çalışılmaktadır. İlgili kanunda dezavantajlı bireyler; kadın, çocukgenç, yaşlı, engellieski hükümlüterör mağdurları olarak gruplandırılabilmektedir. Nicel araştırma deseni üzerine kurgulanan çalışmada, araştırma konusu ile ilgili değişkenler arasında istatistiksel olarak anlamlı bir farklılık olup olmadığı bağımsız iki örneklem t-testi ve ki-kare analizleriyle sınanmıştır. Analiz sonuçlarına göre kadınların, kanuni düzenlemelere aykırı biçimde, erkeklerden daha düşük düzeyde ücret geliri elde ettikleri; ancak, kanuna uygun olarak yeraltında ve sualtında sınırlı düzeyde istihdam edildikleri belirlenmiştir. Çocuk çalışanların yaklaşık 40ı mevzuata aykırı biçimde haftada 45 saatin üzerinde çalışmaktadır. Atmışbeş yaş üstü bireylerin ise önemli kısmının tarım sektöründe, kendi hesabına ve kayıt dışı olarak faaliyet gösterdikleri belirlenmiştir. Bir diğer dezavantajlı grup ise engelli, eski hükümlü ve terör mağdurlarıdır; ancak HİAMVSde bu grubun istihdamına ilişkin sınırlı veri bulunduğundan istatistiksel analiz gerçekleştirilememiş; ilgili grup, yalnızca kanunda yer alan hükümler çerçevesinde değerlendirilebilmiştir.
