Özet:

Magna Carta, a document adopted in the 13th century England, usually represents the starting point in the history of human rights. The general belief prevails that this document has a separate and special meaning from other examples that have been accepted to that day. The aim of this research is to examine the legal nature of Magna Carta and to reveal its connection with the current understanding of human rights. It is aimed to determine the historical background of the document and the purpose for which it was made by examining it on the axis of the concepts of state theory. For this reason, the research firstly focused on the historical process leading to the adoption of Magna Carta. The administrations of King John, who accepted Magna Carta, and the Kings before him have been examined. Then the type, sides and content of the document were revealed. It has been examined which type Magna Carta represents as a legal document, the social positions of the kings and barons as parties, and what issues are included in its content. In this sense, especially the original text of Magna Carta, which contains changes and the Coronation Charter of Henry I and other historical and legal primary sources, as well as secondary and literary works have also been used.
