 The Court of Justice of the European Union, in its judgment C-5518 dated 14052019 on the registration of working hours following an application for an opinion by the Spanish judiciary, has set out an important case law. In this case-law, the Court concluded that the establishment of an effective, transparent and reliable registration system is essential for the protection of workers rights, in particular those set out in the Working Time Directive and the Health and Safety at Work Directive. The Spanish Courts view that only overtime working hours should be recorded and normal working hours should not be recorded was not accepted by the Court of Justice of the European Union on the grounds that it was contrary to the basic European Union directives on labour law. On the grounds that the European Union directives bind the Member States in terms of the objective to be achieved, the Court states that domestic case law contrary to the directives should be reversed and the provisions of the legislation should not be applied. In its reasoning, the Court concluded that, in order to maintain maximum daily and weekly working hours, working time must be recorded through an effective, transparent and reliable system.

 Avrupa Birliği Adalet Divanı, İspanyol yargı organlarının görüş almak üzere yapmış olduğu başvuru üzerine çalışma sürelerinin kayıt altına alınmasına ilişkin olarak C-5518 ve 14052019 tarihli kararı ile önemli bir içtihat ortaya koymuştur. Divan bu içtihadıyla başta Çalışma Süreleri Direktifinde ve İş Sağlığı ve Güvenliği Direktifinde düzenlenen işçi haklarının korunması için etkili, şeffaf ve güvenilir bir kayıt sisteminin kurulmasının zorunlu olduğu sonucuna varmıştır. İspanyol Mahkemesinin sadece fazla çalışma sürelerinin kayıt altına alınması gerektiği, normal çalışma sürelerinin kayıt altına alınması gerekmediği görüşü, Avrupa Birliği Adalet Divanı tarafından İş Hukuku ile ilgili temel Avrupa Birliği direktiflerine aykırı olduğu gerekçesi ile kabul görmemiştir. Divan, Avrupa Birliği direktiflerinin ulaşılması istenen amaç bakımından üye devletleri bağladığı gerekçesi ile direktiflere aykırı yerel içtihatlardan dönülmesi gerektiğini ve mevzuat hükümlerinin uygulanmaması gerektiğini söylemektedir. Divan gerekçesinde, günlük ve haftalık azami çalışma sürelerinin korunması amacıyla çalışma sürelerinin etkili, şeffaf ve güvenilir bir sistem aracılığıyla kayıt altına alınması gerektiği sonucuna ulaşmıştır.
