Annulment of ICSID Arbitral Awards due to Serious Departure from a Fundamental Rule of Procedure

 Investment disputes differ from other disputes due to the high amounts involved and the fact that one of the parties is a state. This is also the case in terms of the resolution of these disputes. The resolution of these disputes in arbitration differs from the resolution of commercial disputes in arbitration or through the courts. The ICSID Convention, which aims to resolve investment disputes effectively, is one of the most widely recognised international conventions in the world. Therefore, the arbitration and conciliation activities carried out under ICSID are also important for the international public opinion. This is because this activity directly and indirectly concerns a very large mass of people. Therefore, the supervision Interpretation, Revision and Annulment of arbitral awards rendered under ICSID is also of great importance. To this end, the ICSID Convention clearly sets out the conditions under which arbitral awards may be annulled. One of these conditions is that the arbitrator or the arbitral tribunal has seriously departed from a fundamental rule of procedure in reaching its award. This condition generally corresponds to the equal treatment of the parties in the arbitration process, the right to a fair trial, the right to be heard, the independence and impartiality of the arbitrators, and the parties right of proof. Therefore, the annulment of arbitral awards for breach of this requirement will be discussed in this article within the framework of the aforementioned topics. In the study, the annulment processes completed within ICSID are generally mentioned, and the subject of the research is explained and evaluated through some prominent decisions in doctrine and practice in order to ensure the integrity of the subject and to determine the scope.

 Yatırım uyuşmazlıkları gerek dava konusu meblağların yüksekliği gerekse de taraflardan birisinin bir devlet olması nedeniyle diğer uyuşmazlıklardan ayrışmaktadır. Bu husus, söz konusu uyuşmazlıkların çözümü bakımından da söz konusudur. Zira bu uyuşmazlıkların tahkimde çözümlenmesi, ticari uyuşmazlıkların tahkimde veya mahkemeler eliyle çözümlenmesine göre de farklılık arz etmektedir. Yatırım uyuşmazlıklarının etkin bir şekilde çözümlenmesini amaçlayan ICSID sözleşmesi, Dünyada en geniş şekilde kabul gören milletlerarası sözleşmelerden bir tanesidir. Bu nedenle, ICSID bünyesinde yürütülen tahkim ve arabuluculuk faaliyeti de milletlerarası kamuoyu bakımından önem arz etmektedir. Zira, bu faaliyet doğrudan ve dolaylı olarak çok büyük bir kitleyi ilgilendirmektedir. Dolasıyla, ICSID bünyesinde verilen hakem kararlarının denetimi yorum, düzeltme ve iptal de büyük bir önemi haizdir. Bu amaçla, ICSID Sözleşmesinde hakem kararlarının hangi şartlarda iptal edilebileceği açıkça düzenlenmiştir. Hakemin veya hakem heyetinin kararını verirken temel bir usûl kuralından ciddi şekilde sapmış olması da bu şartlardan bir tanesidir. Bu şart, genel olarak tarafların tahkim sürecinde eşit muamele görmesi, adil yargılama yürütülebilmesi, hukukî dinlenilme hakkına riayet edilmesi, hakemlerin bağımsızlığı ve tarafsızlığı ile tarafların ispat hakkına tekabül etmektedir. Dolayısıyla, hakem kararlarının bu şarta aykırılık nedeniyle iptali de anılan başlıklar çerçevesinde bu makalede ele alınacaktır. Çalışmada, ICSID bünyesinde tamamlanan iptal süreçlerine genel olarak değinilmiş, araştırma konusu, konu bütünlüğünün sağlanabilmesi ve kapsamın belirlenebilmesi adına doktrinde ve uygulamada öne çıkmış bazı kararlar üzerinden izah edilmiş ve değerlendirilmiştir.
