Özet:

Peer bullying is a common phenomenon, especially among school-age children, and involves emotionally, psychologically or physically damaging behaviors. Behaviors of this nature not only affect the social and emotional development of individuals, but can also have serious consequences for social peace and security. Today, peer bullying is no longer seen as simple problems between friends and is considered as a form of behavior that has been the subject of serious research with legal consequences. In this context, the issue needs to be addressed within the scope of criminal law. Although peer bullying is mostly seen among individuals between the ages of 10-29, since it is mostly seen among children, our study was planned to include only children. Bullying is defined as repetitive actions characterized by power imbalance in order to disturb the peace of the person and to make himher suffer. In this respect, systematic acts of intimidation and harm between individuals with power inequality characterize peer bullying. In particular, non-systematic acts cannot be evaluated within this framework. Bullying acts may be psychological, physical or directed against personal freedom. It is possible that these behaviors also have criminal responsibility. The source of bullying may be psychological or due to environmental factors. In our study, after discussing the criminal responsibility of children as perpetrators of bullying, the types of crimes that can be committed by children within the scope of bullying activities are discussed.
