Özet:

According to the Constitution of the Republic of Turkey, it is the right of employees to rest art. 50 and the rights and obligations of civil servants are regulated by law art. 128. Referring to these articles, the legislator has specified the working hours in personnel legislation, especially the Civil Servants Law No. 657. Generally, these working hours are determined as 40 hours per week. One of the obligations of civil servants is to be on duty and perform duties personally within the working hours regulated in the legislation. Besides, some public services such as health and law enforcement are services that must be provided 24 hours a day due to their nature. Since it is essential for the personnel working in shifts to provide such services, it is not always possible to comply with these weekly working hours determined by law. Anticipating this, the legislator had need for regulating the issue separately in art. 101 of the Civil Servants Law No. 657. When 99 and 101. articles of Civil Servants Law No. 657 are evaluated together and the jurisprudence of the courts on the subject is taken into consideration, it is understood that the 40 hours weekly working is not the minimum or maximum duration. The conclusion that emerges from these explanations is as follows: For some public services, such as health and law enforcement, working hours of less than 40 may be determined, taking into account the nature of the work and the number of personnel. And if the working hours exceed 40 hours per week, additional payment must be made to the civil servants.
