Özet:

In this article ,what needs to be done to properly rely on witness evidence, which is one of the most frequently used evidence in practice, will be examined. As a matter of fact, witness evidence is one of the most frequently used evidence and it is very important in terms of clarifying many cases. Particularly in cases where the principle of being brought by the parties prevails, the evidence on which the parties rely is clearly defined and the period of presenting evidence is limited to a certain stage of the trial raises the evidence of the parties. And In this context, it raises the question of how far they can present the witness evidence. In this context, it will be emphasized that it is necessary to rely on witness evidence explicitly and that the time given to show evidence to the party that does not rely on witness evidence will not have any results. Because, as it is often mentioned in the decisions of the Supreme Court, the time given by the court to present the evidence that is not based on by the parties is of no importance. After emphasizing the submission to the court of the list stating the names and addresses of the witnesses to be heard by the party relying on the witness evidence in this context, the prohibition of giving a second witness list, the fact that this prohibition is in public order and the exceptions to this prohibition, are mentioned by conveying the views in practice and the doctrine. In this research, especially in the law number 6100, by examining the effect of the changes made with the law number 7251 dated 22/07/2020 in terms of the period of submitting witness list, within the scope of these alterations, it has been tried to point out that there is no obstacle in drawing the time to be given to the parties to submit a list of witnesses to the pre-examination hearing invitation stage.
