Özet:

One of the most important agenda item is violence against women nowadays. Individuals of the modern society have been experiencing the violence since the early ages of mankind and still didn’t get the lesson from the past. Free from time and space, subject of the violence is generally the women. The intensive pain can be read from archive records which were the witnesses of past. It is possible to perceive the violence from the court order. The aim of this paper is to examine domestic violence from the book of “Mühimme”,“Şikayet”,“Ahkam”and“CourtRecords”,“.Andwhileexaminingthis, pastsolutionswillalsobe indicated. Women demanded justice to protect their justice and notify the violance and maltreatment. The unresolved cases of the domestic court are escalated to “Divan-ı Hümayun” a superior court. Women were coming to İstanbul, from every part of the empire, for the superior court (“Divan-ı Hümayun”) or rep- resented by an attorney send by them to put out of their misery. Alternative solution is getting a divorce. In this kind of cases “hul‘” or “muhâla‘a” represents the divorcement triggered by the demand of women. There is a significant amount of documents representing urbanized women in Sharia Court. But for the countrywomen, the case of an application to the superior court is referred as an extreme case. Despite the fact of distance, countrywomen were reaching the superior court from all over the empire. The history of harassment and the experience of the resistance may give us the power of a solution.
