Özet:

This study explores the concept and applications of suftajah, a practice involving the repayment of debt in a different location, within the framework of Islamic law. When suftajah is used to shift the risks and costs associated with transferring money to the debtor, it is generally considered impermissible by Islamic jurists. However, if conducted purely for goodwill, without any conditions of benefit, suftajah transactions are deemed permissible. This aligns with the principle in Islamic legal doctrine that a lender should not seek any personal gain from a qard al-hasan, acting solely for the sake of Allahs pleasure. The research investigates the suftajah as a precursor to the bill of exchange, a key instrument in the law of negotiable instruments. It begins by analyzing the term suftajah from a conceptual perspective, examining how it is defined in classical Islamic legal texts, dictionaries, and contemporary studies. Next, the study reviews various forms of suftajah practiced historically by merchants. Finally, the views of different Islamic schools of law on the legal ruling of suftajah are presented, tracing the development of these rulings over time and analyzing their legitimacy from a jurisprudential standpoint. Methodologically, the study relies on textual analysis of primary fiqh sources and comparative evaluation of legal opinions across different madhhabs.
