Özet:

Compensation for loss of support is a distinct category of tort law that aims to redress the economic damage suffered by individuals who were receiving material assistance from a deceased person during their lifetime. This form of compensation enables persons who are not directly affected by an unlawful act but who have genuinely relied on the deceaseds support to make claims outside the general rules of liability. However, granting this right without appropriate boundaries may lead to unjust and unintended consequences. Therefore, the concept of support, which forms the legal foundation of such claims, must be carefully examined. In particular, it is essential to assess whether exceptional or temporary forms of assistance qualify as support and to evaluate the elements of regularity, continuity, and legitimate expectation within each specific case. This study focuses on the legal structure and function of the concept of support in the context of compensation for loss of support. It explores its doctrinal boundaries, practical challenges, and judicial interpretations, with the aim of developing a fairer and more consistent framework for its application. The ultimate goal is to contribute to a more equitable understanding of the institution and to prevent its misuse in legal practice.
