Özet:

Hüsâm Çelebîs real name is Hüsâmüddin Hüseyin bin Abdurrahman. Hüsâm Çelebî, who is from Tokat, is one of the 16th century scholars of the Ottoman state. He worked as a mudarris, kadi and mufti in various provinces of the Ottoman Empire. He trained many students and wrote works in the fields of fiqh and kalam. He wrote hashiya, taliq and risâleler on various subjects, most of them in the field of fiqh. The work named Risale-i naklüş-şehâde, which is determined to be one of his works and which is the subject of this study, is located in the Hacı Selim Ağa Library in the number 379 of the Hacı Selim Ağa section 297.5 as a single copy. In this work, the author deals with the transfer of testimony. Under normal circumstances, the plaintiff and the defendant should be present at the court to defend their rights, but it may be the case that the plaintiff and the defendant, the witnesses reside in different cities and cannot come together. In such a case, the transfer of the testimony is one of the methods used in order to obtain the rights due to the filing and conclusion of the case. The author dwells on the mistake made by the judges of his time by stating that they expressed opinions contrary to the Shariah provisions and did not distinguish between an existing, ready, determined movable property and others. At the end of his work, if it is accepted that the transfer of testimony is permissible according to the preferred view on all movables, the author explains in detail the process of transferring the correct witness, by giving an example, after emphasizing that the way of adjudicating on movables and the legal letter sent must be of the same quality. Studying this subject is important in terms of the fact that the issue of the transmission of testimony still remains on the agenda, it is a subject that has not been researched, and a work found as a manuscript has not been studied before. The aim of this study is to provide general information about Hüsâm Çelebi and his works, to present the authors related work and the subject mentioned there, to the benefit of those who will do research on this subject, and to contribute to the field in this regard.
