Özet:

After the death of the deceased, disagreements among heirs, major disputes, or the inability to reach one or more of the heirs may result in a situation where no decisions can be made or actions taken regarding the assets included in the estate. In such cases, it is possible for a representative to be appointed to the co-heirship upon the request of one of the heirs. This representative differs from a voluntary representative both in terms of the appointment procedure and in the scope of rights and obligations. Once appointed, the representative is granted management authority, while the rights and powers of the heirs over the estate are restricted. Therefore, appointing a representative to the community of heirs has significant consequences. For this reason, it is crucial to define the powers and responsibilities of the representative and the limits of those powers. In this study, general information regarding the representative of the community of heirs under Turkish law is provided, followed by a discussion on the legal basis of this institution. Subsequently, regulations concerning the representative of the community of heirs under Swiss law and explanations on the management of the community of heirs in German law are presented to offer a comparative perspective. Finally, the powers and obligations of the representative are addressed, focusing on controversial issues.
