Özet:

In pre-industrial societies, where individual property was not promoted as much as in modern times, it was one of the general characteristics of the Ottoman land regime to leave the lands outside of agricultural activities to the public or to a specific group for common use. Although there are various types of forests, they were among the indispensable resources of rural society as one of the areas where this property form was applied. The institution of communal property did not undergo structural change in the case of forests until the second half of the nineteenth century. However, since the mentioned period, in parallel with the development of scientific and rational forestry, there has been a serious contraction in the ancient rights of the villagers based on joint ownership. In this period, the regulations made in the forest law legislation made the access of the villagers to the forests subject to strict state control. This study will evaluate the developments in forest law legislation in the late-Ottoman Empire in terms of the common rights. Taking the 1858 Land Code as a starting point, the study will follow the evolution of these rights through different forest types such as coppices, mîrî forests and cibâl-i mübâha forests.
