Özet:

It was seen that the new international order established with the dissolution of the Soviet Union and the end of the Cold War differed greatly from the current system, the economic foundations of which were laid with Bretton Woods in 1944 and the institutional structure of which was established with the establishment of the United Nations on October 24, 1945.This differentiation has also formed the basis of the conflicts and crises that arose. Within the framework of the UN Treaty, it has been clearly revealed that the hegemonic powers, especially the USA, who provide legality and legitimacy to the use of force in the international arena, do not want to stay within the borders of the UN in the new order. At this point, it has been observed that new concepts have come to the fore in international law. Humanitarian intervention is at the top of these concepts. The concept of humanitarian intervention has led to the emergence of a deep conflict between the sovereignty and political integrity of states, human rights and freedoms. The concept of Protecting Nationals Abroad, a concept that is often confused with humanitarian intervention, is one of the new concepts that come to the fore in international law. It was seen that the Russian Federation referred to this concept as the main argument in its intervention to the conflicts between Georgia and South Ossetia in 2008. In this study, the concept of Protection of Nationalities Abroad, which has uncertainties about its definition, will be clarified and the Russian Federations intervention in South Ossetia in 2008 will be discussed within the framework of this concept.
