Özet:

Muslim jurists have stipulated several conditions for Friday prayers validity, obligation, and performance. Among these conditions is settlement. Settlement can be defined as residing in a place intending to not leave except for a necessity and then returning to it. Considering the place where Friday prayer is performed, settlement is a condition of validity, so Friday prayer is not valid in uninhabitable lands, such as deserts and mountain peaks. Also, considering the group of accountable people performing the Friday prayer, settlement is a condition for the validity, obligation, and performance according to the majority of jurists, unlike the Hanafis, who did not stipulate such a condition. Residency that nullifies the provisions of travel is a condition for the obligation of Friday prayer according to all jurists, and it is a consequential obligation. However, residence without settling in the place makes the person among those not counted for the performance of Friday prayer, so he is not counted among the number necessary for the prayer to be performed according to the majority, unlike the Hanafis. The research concluded that the residence that nullifies the provisions of travel is sufficient to obligate Friday prayer and consider it valid, and to be performed by a person without regard to his settlement, so the texts commanding Friday prayers in this matter did not differentiate between a settler or someone else. Other results will come at the end of the research. Among the contemporary applications is residing in ruined villages and cities that have been destroyed due to earthquakes and floods, and differentiating between the intention of their people to rebuild it or to leave it and move to another place. Among the applications is also the issue of asylum seekers and whether they meet this condition. Other applications to be discussed in the research.
