 The fact that it is possible within the framework of the current legislation especially TCC Art. 175 to rule on poverty divorce alimony indefinitely causes policy makers to bring the legislation that allows this to the agenda at various times and to make promises to change the law to those whose legal situations are affected. Of course, it is possible to discuss various aspects of the relevant legislation, especially in terms of equity. However, should the unfair results of the legislation in question be abolished or amended in order to be completely or partially eliminated? Or is it possible to obtain more equitable results, even without the need for any legislative amendment, by interpreting the aforementioned current legislation in its current state, but with methods suitable for the establishment of concrete case justice? In this study, especially the provision of TCC Art. 175 was examined in terms of legal interpretation methods and it was evaluated whether any law amendment or abolition would be a remedy for social, political and legal debates in terms of equity; in other words, it has been argued that such a change in law would be necessary or unnecessary in terms of establishing equity.

 Yoksulluk boşanma nafakasına süresiz olarak hükmedilebilmesinin yürürlükteki mevzuat özellikle TMK m. 175 çerçevesinde prensip itibariyle mümkün olması, özellikle politika yapıcıların buna olanak tanıyan söz konusu mevzuatı çeşitli dönemlerde belirli aralıklarla gündeme taşımalarına ve bundan hukukî durumları etkilenecek ya da etkilenmekte olan kişilere değişiklik veya ilga vaatlerinde söylemlerinde bulunmalarına yol açmaktadır. Elbette ilgili mevzuatın özellikle hakkaniyet bakımından çeşitli yönleriyle tartışılması mümkün ve doğaldır. Ancak söz konusu mevzuatın kimi yaklaşımlara göre hakkaniyete aykırı neticelerinin tamamen veya kısmen bertaraf edilebilmesi için mutlaka ilgası ya da değiştirilmesi mi gerekmektedir? Yoksa adı geçen yürürlükteki mevzuatın mevcut hâliyle ve fakat somut olay adaletinin tesisine elverişli yöntemlerle yorumlanarak, herhangi bir mevzuat değişikliğine gerek bulunmaksızın dahi hakkaniyete daha uygun neticeler alınabilmesi mümkün müdür? Çalışmada konuya ilişkin özellikle TMK m. 175 hükmü hukukî yorum yöntemleri merceği altında incelenerek, herhangi bir değişikliğin veya ilganın hakkaniyet bakımından gerçekleştirilen toplumsal, siyasal veveya hukukî tartışmalara çare olup olmayacağı; başka deyişle böyle bir değişikliğin hakkaniyet tesisi bakımından şart veveya gerekli olup olmayacağı hususunda kanaat getirilmeye gayret edilmiştir.
