Özet:

With the establishment of a lease agreement, both the lessee and the lessor have some secondary obligations other than the primary performance obligations. One of these obligations is the lessees obligation to use the leased property with care and to respect the occupants of the property and the neighbors, which is regulated in Article 316 of the Turkish Code of Obligations. Contrary to Law No. 818, the lessees obligation to respect is regulated as a separate secondary obligation in Law No. 6098, not as a part of the obligation to use the leased property with care. The reason for this is that the importance of the duty of respect is increasing in todays neighborly relations. For this reason, it is necessary to be examined in detail against whom the duty of respect can be violated, which behaviors constitute a violation of the duty of respect, and what legal consequences will arise when the duty of respect is violated. In the study, first of all, since the lessees duty of respect arises from neighborhood relations, Article 316 of the Turkish Code of Obligations will be analyzed comparatively with the relevant provisions of the Turkish Civil Code and the Condominium Law. Then, the subjects of the lessees duty of respect will be determined. At this point, it will be evaluated whether the violation of Article 316 of the Turkish Code of Obligations arises in the event of a breach of the duty of respect towards the lessor and his relatives. In particular, which behaviors are considered as violation of the duty of respect will be examined within the scope of doctrinal opinions and case law. After these examinations, the use of the termination right granted to the lessor due to the lessees violation of the duty of respect will be discussed separately by distinguishing between residential and roofed workplace leases and other lease relationships. In conclusion, the appropriateness of classifying lawsuits arising from disputes under Article 316 of the Turkish Code of Obligations as eviction lawsuits in practice will be evaluated.
