Özet:

The completion of the proceedings within a reasonable time is as important for the decisions of the Constitutional Court through individual applications as it is for the Courts own decisions. The effectiveness of judicial review is inversely proportional to the length of the process. The norms that are claimed to be unconstitutional and annulled by the court are envisaged to remain in force from the day they enter into force until the day the annulment decision is published in the Official Gazette. Throughout the process, it is understood that the legislative power or the first-hand regulatory authority of the executive is inevitably preferred to the principle of supremacy of the constitution. Unlike doctrinal legal studies, this study, which focuses on the judicial review processes of presidential decrees, is a descriptive research and can be considered within the scope of socio-legal studies. The study is limited to the decisions from 22012020, when the first decision on presidential decrees was issued, until 15102023. The periods that are not included in the statistics shared by the Constitutional Court were obtained through the norm database. The duration of the relevant norm review decisions was determined by taking into account the different stages such as the publication of the norm, the first review, and the decision; these durations were evaluated in comparison with the laws. In addition, the courts decisions on presidential decrees are detailed. For presidential decrees that were claimed to be unconstitutional, it was found that the duration of the decision was 70 longer in cases where one or more rules were annulled than in cases where the annulment request was rejected. It can be argued that annulment decisions take longer due to the nature of the annulment decision-making process. However, this situation raises concerns regarding the efficiency and functionality of norm review.
