Özet:

The concept of right commonly refers to entitlements recognized by the legal system as vested in individuals. The concept of right, which is at the center of legal thought, is one of the concepts that has received considerable attention in contemporary jurisprudential literature. One of the important subheadings regarding the concept of right is the issue of isqāṭ of rights which refers to the renunciation of rights by their owners based on their will without transferring it to another party. The problem of the isqāṭ of rights in Islamic jurisprudence has been approached through the conceptual frameworks of key distinctions such as the right of Allah-the right of servants, milk-ḥuqūq, and abstract rights. This study primarily focuses on how this problem is addressed in the Ḥanafī school: which categories of rights are deemed renounceable and which are not - in other words, the question of their suitability for isqāṭ. The conceptual framework and jurisprudential thought behind whether rights are suitable for renunciation have been attempted to be determined. In this study, the determinations found in both classical doctrine and contemporary research regarding which rights are considered subject or not subject to renunciation have been compiled and evaluated, and attention has also been drawn to certain criteria that may be considered new.
