Özet:

Legal regulations for the crypto asset sector are of increasing importance both at national and international levels. An important development in this field in Turkey is the enactment of Law No. 7518 on Amendments to the Capital Markets Law so called Cryto Assets Law. While the main purpose of this regulation is to ensure the protection of customer assets and prevent money laundering and terrorism financing, Law No. 7518 also regulates the legal liability of crypto asset service providers by referring to Article 71 of the Turkish Code of Obligations. This paper aims to discuss the practical applicability and possible effects of the relevant regulation by addressing the legal liability of crypto asset service providers within the scope of Article 71 of the Turkish Code of Obligations.

Kripto varlık sektörüne yönelik yasal düzenlemeler, ulusal ve uluslararası düzeyde artan bir öneme sahiptir. Türkiyede bu alandaki önemli bir gelişme, Kripto Varlık Yasası adıyla anılan 7518 sayılı Sermaye Piyasası Kanununda Değişiklik Yapılmasına Dair Kanunun yürürlüğe girmesidir. Söz konusu düzenlemenin temel amacı, müşteri varlıklarının korunmasını sağlamak, kara para aklanmasını ve terörizmin finansmanını önlemek olmakla birlikte 7518 sayılı Kanun, aynı zamanda kripto varlık hizmet sağlayıcılarının hukuki sorumluluğunu da Türk Borçlar Kanununun 71. maddesine atıf yaparak düzenlemiştir. Bu çalışma, kripto varlık hizmet sağlayıcılarının hukuki sorumluluğunu, Türk Borçlar Kanununun 71. maddesi kapsamında ele alarak ilgili düzenlemenin uygulanabilirliği ve olası etkilerini tartışmayı amaçlamaktadır.
